COPS NOT TAKING SECTION 498A SERIOUSLY....IS THIS RARELY HAPPENS IN INDIA?


Recently, cases under Section 498 A were reserved only for the mahila police station in Ahmedabad. But soon, it was issued that registration of FIR under this section will be done at the police stations concerned and the follow-up investigation will be conducted by the personnel of mahila police station only. As a result of this lopsided arrangement, women are not getting justice, believe activists.

AHMEDABAD: The police stations of the city have recently been under the radar for having not being fully cooperative in taking complaints against domestic violence. Ahmedabad Women's Action Group (AWAG) has issued a letter to the commissioner of police about how cases under Section 498 A of IPC is being ignored by the police stations across the city.

Recently, cases under Section 498 A were reserved only for the mahila police station in Ahmedabad. But soon, it was issued that registration of FIR under this section will be done at the police stations concerned and the follow-up investigation will be conducted by the personnel of mahila police station only. As a result of this lopsided arrangement, women are not getting justice, believe activists.

"Police are not taking cases under this section. Women who have been abused physically are counselled to go back to their families and not file complaints. They are told how bleak their future will be if they try to get their husband or family punished by law. Scared of that, these women go back to the square one," said Sara Baldiwala from AWAG. She explained that this is being done to keep the police records clean of cases on domestic violence.

The women's group has demanded that if women are being assaulted, they must get justice. "Most of these women come from poor background. In half of the cases, women are beaten frequently by their husbands who don't do any work. These women don't need to be counselled, it is the husband or the accused who must be punished instead," Baldiwala said.

Distance is also a big deterrent for these harassed women. "If a woman in Bapunagar is assaulted, one cannot expect her to travel across the city to get her complaint registered at the mahila police station. She will lose her determination to get justice in most cases," added Baldiwala, who says there hasn't been a response from the commissioner's office yet.

Dhirubhai Mistry of People's Union for Civil Liberties, Vadodara, said, "Police do not file complaints in most cases and often ask irrelevant questions. A year after Nirbhaya's death, changes we see are very less."



  AHMEDABAD: On the face of it, there has been a sharp drop in domestic violence against women in Ahmedabad in recent days. Only two FIRs have been filed under IPC section 498, which deals with dowry complaints, in the last two weeks, down from an average 150 FIRs a month till October.

But that does not mean more couples have discovered marital bliss overnight. Instead, a quirky decision of the city police, taken earlier this month, seems to have camouflaged rising crime against women.

The cops have decided that all dowry complaints will be handled by the city's only 'mahila' police station at Mithakali. Victims of domestic violence could go to any police station earlier and lodge a complaint under Section 498A. Since November 10, the mahila police station has filed FIRs only after counseling the complainant. Often, women don't file FIRs after a counseling session.

Ironically, the mahila police station has received 249 complaints of matrimonial disputes falling under Section 498A since November 10.

Take Harshida Patel (35) approached Naroda police station on November 12 and filed a complaint of domestic violence and harassment for dowry against her husband and in-laws. Two hours later, she was taken to the mahila police station which did not register an FIR and advised her instead to prepare for counseling. Despite this, Harshida is keen to file an FIR but the cops have remained adamant.

Her lawyer, Anand Brahmbhatt, said the cops are violating a recent Supreme Court order directing the police to register an FIR immediately.
Women's rights activist Ilaben Pathak of AWAG said, "Ahmedabad is a large city and there is no point in having just one police station for accepting complaints. Women should be free to lodge complaints at the nearest police station irrespective of jurisdiction. Besides, how can the police provide counseling?"
